Terms of Magic

1. Acceptance of Magic

By accessing or using the Santa Says service ("the Service"), you agree to be bound by these Terms of Magic. If you do not agree to these terms, please do not use our services to contact the North Pole.

2. The Service

Santa Says provides personalized video messages generated using advanced artificial intelligence technology ("Elf Tech"). You acknowledge that:

  • The videos are synthetic media and not actual recordings of the historical figure known as Saint Nicholas.
  • Delivery times are estimates based on elf workload and are not guaranteed, though we strive for holiday timeliness.
  • We reserve the right to refuse any request that violates our "Naughty List" policy (see Section 4).

3. User Responsibilities

When submitting a request, you agree to:

  • Provide accurate and appropriate information about the recipient.
  • Ensure you have the necessary consent to share any personal details (names, photos, etc.) of the child or recipient.
  • Not use the service for any unlawful, harmful, or malicious purpose.

4. "Naughty List" Policy (Prohibited Content)

We strictly prohibit the generation of content that includes:

  • Profanity, hate speech, or harassment.
  • Adult themes, violence, or inappropriate situations for children.
  • Any content that would tarnish the reputation of Santa Claus or the North Pole.

Violations will result in immediate cancellation without refund and a permanent ban from the Service.

5. Intellectual Property

Upon purchase and delivery, you are granted a non-exclusive, perpetual license to share and display your personalized video for personal, non-commercial use. North Pole Productions retains ownership of the underlying technology, templates, and Santa's likeness rights.

6. Refunds and Cancellations

Due to the personalized nature of our magical products:

  • Refunds are not generally available once the video generation process has begun.
  • If there is a technical error or a significant quality issue (e.g., mispronunciation), please contact Elf Support within 7 days for a correction or refund.

7. Disclaimer of Warranties

The Service is provided "as is." While we aim for maximum magic, we cannot guarantee that the AI generation will be 100% perfect or indistinguishable from reality in every instance.
